Gift Vouchers and Gift E-Cards

These Voucher/Gift Card Terms govern the use of GIGI&TOM Vouchers/Gift Cards. These Terms constitute a binding legal agreement between Haeven Pty Ltd (GIGI&TOM, 'we', 'us', or 'our') and the person purchasing, redeeming or attempting to redeem a GIGI&TOM Voucher/Gift Card (you). These Terms are to be read in conjunction with our Terms + Conditions and other Terms or Policies.

 

These Voucher/Gift Card Terms apply when you purchase, redeem, attempt to redeem or undertake a balance enquiry of a GIGI&TOM Voucher/Gift Card (collectively ‘using’ a GIGI&TOM Voucher/Gift Card). By using a GIGI&TOM Voucher/Gift Card, you warrant and represent to GIGI&TOM that you have read and agree to be bound by these Terms and that you will not undertake any fraudulent or misleading conduct relating to a GIGI&TOM Voucher/Gift Card. If you are giving a GIGI&TOM Gift Card as a gift, it is your responsibility to ensure that the recipient is aware of these Terms.

 

 

 

 

 

 

 

VALIDITY + EXPIRY
GIGI&TOM Gift Cards are valid for 3 years from date of purchase, irrespective of when the recipient may receive it; will be activated within 24hrs of purchase; can be redeemed against all products except other GIGI&TOM Gift Cards, are non-transferable and may not be returned or redeemed for cash. Taxes (such as GST) and/or shipping is still applicable on any products purchased with a GIGI&TOM Gift Card. All GIGI&TOM Gift Cards are in Australian dollars (AUD). Once your GIGI&TOM Gift Card has expired or reached a zero balance, it is no longer valid and cannot be reloaded, reactivated or refunded.

 

 

 

If the GIGI&TOM Voucher/Gift Card is used on a purchase of a lower value than the amount remaining on a GIGI&TOM Voucher/Gift Card, the remaining amount will resume on the same GIGI&TOM Voucher/Gift Card. This can then be used on future purchases and will be valid to the same GIGI&TOM Voucher/Gift Card expiry period. If a purchase exceeds the value of the GIGI&TOM Voucher/Gift Card, the remaining amount must be paid for by another payment method, such as cash card, Afterpay or PayPal.

If you buy a GIGI&TOM E-Gift Card:

a) the Gift Card will be emailed to the recipient once the full order has been processed and payment has been made (unless an alternate date is selected). An invoice with proof of purchase will be sent to the purchaser as confirmation;

b) the Gift Card will include a unique code that can be used online. The unique code needs to be entered at the point of reviewing items in an order (in the checkout process);

c) you are responsible for ensuring you have entered the correct full name and email address for the recipient. GI&TOM is not liable for delivery of a GIGI&TOM Gift Card to an incorrect or non-existent email address; and

d) promotion codes cannot be applied to the purchase of a GIGI&TOM Gift Card.

 

 

Products that are purchased wholly or partially with a GIGI&TOM Voucher/Gift Card may be exchanged or returned in accordance with our Returns Policy, any amounts paid by other tender will be refunded either for GIGI&TOM Credit (if the purchase was a Sale item) or in the same tender to the same account in which the purchase was made.

 

 

 

You cannot exchange your GIGI&TOM Voucher/Gift Card for a different denomination of Voucher or for another tender, cash or discount. GIGI&TOM Gift Cards cannot be returned for change of mind.

 

 

 

GIGI&TOM is not responsible if a GIGI&TOM Voucher is lost, stolen, destroyed or used without permission. GIGI&TOM Vouchers should be treated like cash and will not be replaced or refunded if they are lost or stolen.

 

 

 

GIGI&TOM Vouchers cannot be cancelled once they are issued, except if used, expired or otherwise cancelled by GIGI&TOM. GIGI&TOM reserves the right to cancel or alter the balance of a GIGI&TOM Voucher if such action is deemed necessary by GIGI&TOM, without notice to you, including but not limited to, where a Voucher is defrauded, stolen, defaced, mutilated, altered, issued in error or otherwise tampered in any way. Where GIGI&TOM has cancelled or voided your GIGI&TOM Voucher due to GIGI&TOM's fault or negligence, GIGI&TOM will provide you with a refund or replacement GIGI&TOM Voucher.

We reserve the right to cancel or block your GIGI&TOM Voucher if you report it stolen or if we consider that you are using it in a manner that is inconsistent with these Terms.

GIGI&TOM Vouchers/Gift Cards are not legal tender, account/credit/debit cards or securities and no transaction statements will be sent to you regarding your GIGI&TOM Voucher/Gift Card.

 

 

 

You agree that you are responsible for the use and protection of your GIGI&TOM Voucher/Gift Card and that you are liable for all transactions on your GIGI&TOM Voucher/Gift Card, except to the extent to which there has been fraud or negligence by GIGI&TOM.

 

You have certain rights under the Australian Consumer Law which cannot be excluded and are not affected by these Terms. To the maximum extent permitted by law, GIGI&TOM excludes all other liability whatsoever to the you arising out of or in any way connected with these Terms, including any liability for consequential or indirect losses of any kind, loss of profit, revenue or goodwill, howsoever arising and whether caused by breach of statute, breach of contract, negligence or other tort. To the maximum extent permitted by law, our maximum aggregate liability to you is limited to the purchase price of your GIGI&TOM Voucher/Gift Card.

 

 

 

A provision of these Voucher/Gift Card Terms or a right created under it, may not be waived or varied except in writing with the consent of each of the parties.

 

 

 

Any provision of these Voucher/Gift Card Terms that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions of these Voucher/Gift Card Terms nor affect the validity or enforceability of that provision in any other jurisdiction.

 

 

 

These Voucher/Gift Card Terms are governed by the law of New South Wales. Each party submits to the exclusive jurisdiction of courts exercising jurisdiction there in connection with matters concerning these Voucher/Gift Card Terms.

 

 

 

These Voucher/Gift Card Terms may be amended from time to time by GIGI&TOM and the latest version will be published on the GIGI&TOM website. It is your responsibility to keep up to date with these Terms. GIGI&TOM reserves the right to amend these Voucher/Gift Card Terms at any time for any reason by two (2) weeks’ notice to you via the GIGI&TOM website. If you do not agree with such amendments, you may contact us and we will cancel and refund your Voucher/Gift Card or provide an alternate resolution. Any amendments to these Terms will apply to all Vouchers/Gift Cards purchased or redeemed after the amendment date.
